Terms of Use for AmbientCalm Mobile & Desktop Software
01Acceptance of Terms
By downloading, installing, accessing, or using AmbientCalm ("the Application"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to all of these terms, do not install or use the Application.
02License Grant & Permitted Use
We grant you a personal, revocable, non-exclusive, non-transferable, limited license to download, install, and use AmbientCalm strictly for your personal, non-commercial use on compatible devices owned or controlled by you.
You explicitly agree NOT to:
- Reverse engineer, decompile, disassemble, or derive source code from the Application.
- Modify, adapt, translate, or create derivative works based upon the Application.
- Rent, lease, lend, sell, redistribute, or sublicense the Application.
- Remove, alter, or obscure any proprietary notices, copyright, or trademark markings.
03Intellectual Property Rights
The Application, including all graphics, code, user interfaces, branding icons, design elements, algorithms, and documentation, is the exclusive intellectual property of AmbientCalm and its licensors, protected under international copyright, trademark, and intellectual property laws.
04Offline Architecture & Local Data Backup
AmbientCalm operates strictly as a 100% offline application without cloud backend synchronizations or remote backup servers. You acknowledge and agree that:
- You are solely responsible for preserving, backing up, and safeguarding your local device data.
- We are not responsible for any lost, corrupted, or unrecoverable data resulting from device damage, hardware failure, factory resets, or app uninstallation.
05Application Modifications & Updates
We reserve the right to modify, update, suspend, or discontinue any feature, tool, or functionality of AmbientCalm at any time with or without prior notice. Updates released through app store platforms will be governed by these Terms unless accompanied by a separate revised license.
06Audio & Relaxation Disclaimer
AmbientCalm provides ambient soundscapes, white noise, and relaxation audio mixing tools strictly for personal focus, meditation, and stress management. It is not a clinical medical device and does not diagnose or treat insomnia, sleep apnea, or anxiety disorders.
07Limitation of Liability & Warranty Disclaimer
AmbientCalm IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
IN NO EVENT SHALL THE DEVELOPERS, AUTHORS, OR COPYRIGHT HOLDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APPLICATION.
08Indemnification
You agree to defend, indemnify, and hold harmless AmbientCalm, its developers, and contributors from and against any claims, liabilities, damages, judgments, awards, losses, costs, or fees arising out of or relating to your violation of these Terms or misuse of the Application.
09Governing Law & Severability
These Terms shall be governed by and construed in accordance with standard international software licensing principles, without regard to conflict of law provisions. If any provision of these Terms is found unenforceable, that provision shall be severed and the remaining provisions shall remain in full force.
